The company FATA SRL (landlord), with headquarter in Via Badia, 14 – 55041 CAMAIORE (LU) – Tax code and VAT number: IT02474660467 – leases, just for holiday purpose, the selected apartment, in the property named CASALE LA FATA, located in Via Provinciale Est 10701- 55041 CAMAIORE (LU), to the guest (leaseholder) in the reserved period.
Art.1: GENERAL TERMS AND CONDITIONS
The selected apartment is completely available to the guest during the reserved period.
The reservation will be valid with arrival date (check-in: from 16:00 h to 19:00 h) and departure date (check-out: before 10:00 h) selected at the booking.
The accepted rate includes: wi-fi internet, water, electricity, gas (kitchen and hot water), weekly linen change (small, medium and large towels, for each guest, bed linen).
The rate does not include: the cost of final cleaning (fixed charge € 100).
Tourist tax is also excluded (currently not applied).
In case of check-in after 20:00 h (but not later than 23:00 h), a surcharge of € 20 will be applied. Check-in will not be possible after 23:00 h and must be made the following morning.
Internal services: Wi-Fi Internet, satellite TV, pots, crockery, coffee maker, toaster, four burners, extractor hood, oven, fridge-freezer, dishwasher, washing machine, hairdryer, weekly linen change (small, medium and large towels, for each guest, bed linen) and heating (since October to April: to be applied according to consumption (€ 5,50 cu.m.), on request, cots (€ 20) and high chairs for children can be provided.
External services for the exclusive use of the apartment: (since May to September) a beach umbrella near the pool with deck chairs and sun loungers, a section of garden with wooden gazebo, table, chairs and barbecue.
Shared external services: (since May to September) fenced swimming pool (open from 9 am to sunset – May to September), outdoor showers.
Free parking area (unattended).
Art.2: PAYMENT
The leaseholder must pay a deposit 30% upon booking, by credit card or PAYPAL account or with a wire transfer into the account (Iban) IT90M0103024600000063257550 by BANCA MONTE DEI PASCHI DI SIENA SPA, in the name of FATA SRL, within and not later than 24 hours. The remaining 70% has to be paid, in the same way, within 20 days before check-in, otherwise the reservation will be cancelled and the deposit retained.
The future guest has to pay the final cleaning fee at the check-in.
The guest has to pay at the check-out the cost for gas for heating use, to be applied according to consumption (€ 5,50 cu.m.).
Art.3: SECURITY DEPOSIT
A security deposit is to be issued on arrival, € 200 cash (to be returned at the check-out, in absence of damages and/or missing parts and/or furniture, after inspection of the apartment).
In case the amount of the damages or absences had to exceed the security deposit, this difference must also be paid to the landlord. In case of refusal of the leaseholder to recognize the due reimbursement, the landlord can proceed by legal action and the cost of this legal action will be fully charged to the leaseholder.
Art.4: CANCELLATION OF BOOKING
In the event that the future guest cancels the reservation before sixty (60) days from the scheduled arrival date, he will be entitled to the refund of the entire amount paid at the reservation. Cancellations made before thirty (30) days from the scheduled arrival date will forfeit a penalty of 50% of the total deposit. Cancellations made after these deadlines result in forfeiture of the entire amount of the deposit or of the expected fee.
Leaving before the date of departure doesn’t guarantee any restitution of the stipulated tariff.
Art.5: RESPONSIBILITY OF THE GUEST/LEASEHOLDER
The guest/leaseholder is liable for dealing the leased apartment with respect. He is
considered responsible for any damage that he or anyone accompanying him has caused to the apartment, appliances and the common parts of the Casale La Fata, as well as to the granted structures, furniture and accessories. He has the duty to ensure that neither he nor the accompanying persons disturb the other guests in the surrounding area, or cause damage to the assets entrusted to them.
In case the customer or one of the accompanying persons acts inappropriately or unacceptable, the landlord can apply the right to cancel the lease immediately and without prior notice and, in addition, he may also request the immediate release of the apartment. In this case, the landlord will not be required to fully or partially reimburse the cost of the lease.
The leaseholder undertakes to host no more than 4 persons, including him.
Hosting in the building of a higher number of people than the agreed one will involve the resolution of the contract.
It is forbidden to sublease the apartment, even partially.
The leaseholder is obliged to give immediate notice to the owner/landlord for anything requiring repairs.
ART.6: RESPONSIBILITY OF THE OWNER/LANDLORD
The landlord must consign the leased apartment in good state of maintenance. He must maintain it in order to serve for the use and perform all the necessary reparations. He must guarantee to the guest the peaceful enjoyment of the lodging during the location.
The landlord is not responsible for any event not directly imputable to its responsibility for serious negligence, guilt or malice, that can limit the enjoyment of the vacation.
ART.7: PETS AND SMOKING
Pets are NOT allowed. Smoking is FORBIDDEN in the apartments.
ART.8: USE OF THE SWIMMING POOL (since May to September)
The Casale La Fata is provided of a private swimming pool, without the assistance of a lifeguard. The landlord cannot be held responsible for any damage caused by the atypical or improper use of the swimming pool, or contravening to the rules of conduct as following mentions.
It is strictly forbidden to enter into the swimming pool area without taking the shower or to adequately have cleaned the feet. It is also forbidden the use of tanning creams and protective products must nonetheless be carefully removed from the body through special shower with soap before using the pool.
It is severely forbidden to dive, plunge or splash. The area surrounding the swimming pool is slippery, therefore it is recommended to use grippy rubber slippers and take utmost care. It is forbidden to play with balls and to run near and inside the swimming pool. Parents or an adult must always accompany and safeguard children and boys younger than 18 years. In case the parents will give their consent, minors aged between 16 and 18 can use the pool even in the absence of parental authority, but the landlord/owner will be always exempt for any damage caused by these, to themselves or to third parties, for which they will always be considered responsible parents, or other subjects to whom minors are entrusted, who are “ex lege” required to keep them. It is the precise responsibility of the parents or other subjects to whom minors are entrusted, if dissenting with respect to the use of the pool in their absence, to enforce this prohibition on the minors.
ART.9: PRIVACY
In accordance with Italian laws, D.Lgs. n. 196/03, and EU regulation 2016/679, the parties, as data controllers, are informed, and allow, that their personal data will be collected and processed on paper, computer, or electronic media, in compliance with the regulations in force, in order to guarantee security and confidentiality, and to comply with legal requirements, as well as for the fulfillment of the obligations under the contract. Personal data will not be disseminated and may be communicated for the finality above, to banks and / or legal / fiscal advisors, institutions (privacy).
ART.10: PLACE OF JURISDICTION
For any controversy may arise for the present contract, is agreed and stipulated the exclusive competence of the court of Lucca.
ART.11: ACCEPTANCE OF THE CONTRACT
Without having paid the deposit within 24 hours, as indicated in art. 2, the reservation referred to this contract shall lapse without effect.
Conversely, the payment of the deposit attests to the complete acceptance of the articles listed in this contract.
